Arbitration Fees

Upon receipt of the $1,750.00 non-refundable administrative fee and the refundable evergreen retainer of $3,500.00, TAG will open your arbitration case. After the case is opened, TAG will send all parties a list of five arbitrators to start the selection process unless the agreement provides other directives.

The responsible party will receive an invoice for fees incurred. The invoice must be paid and the evergreen retainer must be replenished within 30 days of receipt. Disbursements are made to the arbitrators quarterly. If the responsible party does not replenish the evergreen retainer within the allotted time, TAG will suspend the case and charge a non-refundable late fee of $2,500.00 which must be paid with the evergreen retainer.

Mediation Fees

To initiate a mediation with TAG, parties should submit their pleadings. Upon receipt, all parties will be contacted regarding the details of the mediation case.

If the case is currently in arbitration with TAG, TAG will select a mediator who is not the arbitrator in the case. Mediation fees are billed as follows:

  • One-half (1/2) day mediation is $1,500.00 per party
  • Full day mediation is $2,000.00 per party

Administrative and Refundable Fees

Administrative Fee $1,750.00
Evergreen Retainer Fee $3,500.00

TAG will charge the responsible party a one-time, non-refundable administrative fee of $1,750.00 and a refundable evergreen retainer fee of $3,500.00. This is a fixed fee regardless of the number of parties involved or the amount in controversy. All of our arbitrators are billed at an hourly rate for study, hearing, and for travel time, if required, together with reasonable expenses.

When TAG receives the one-time, non-refundable administrative fee and refundable evergreen retainer fee from the responsible party, TAG will send the initial list of five potential arbitrators to the parties to begin the selection process.

The responsible party will receive an invoice for fees incurred. The invoice must be paid and the evergreen retainer must be replenished within 30 days of receipt. Disbursements are made to the arbitrators quarterly. If the responsible party does not replenish the evergreen retainer within the allotted time, TAG will suspend the case and charge a non-refundable late fee of $2,500.00 which must be paid with the evergreen retainer.

Anticipated Fees

  • 1 Day Arbitration $12,000.00
  • 2 Day Arbitration $19,000.00
  • 3 Day Arbitration $24,000.00

Each anticipated additional day of hearing will incur an additional $4,800.00 in anticipated fees.

The arbitrator's hourly rate applies for services such as:

  • Hearings
  • Study time
  • Preparation of award

Upon entry of the first scheduling order, TAG will send an anticipated fee statement. Anticipated fees are due 45 days before the first scheduled arbitration date. The arbitration case will be suspended if the anticipated fees are not received by the deadline. To resume the case, the responsible party must pay an additional non-refundable late fee of $2,500.00, in addition to the anticipated fees. The late fee and the anticipated fees are due from the responsible party. All fees and expenses exceeding the anticipated fees are due within 30 days of the responsible party receiving an invoice.

TAG Cancellation Policy

If parties reach a settlement within 30 days of the arbitration hearing, a cancellation fee of one-half the rate of the anticipated fees will be assessed.

If the parties reach a settlement within 14 days of the arbitration hearing, the cancellation fee will be the full amount of the anticipated fees.

If a case is resolved more than thirty days prior to the arbitration date, the full amount of the anticipated fees will be fully refunded less any outstanding fees due to the arbitrator or mediator for time and expenses incurred.

To avoid cancellation fees, parties are encouraged to schedule dispositive motions, mediations and settlement conferences prior to the deadlines above.
