How do I initiate an Arbitration case with TAG?

To initiate an arbitration case, the claimant or the claimant’s representative should send TAG and the respondent(s)—who will be the defendant(s)—a copy of the “Original Complaint in Arbitration” which is similar to a Plaintiff’s Original Petition. To ensure TAG has the claimant’s contact information, please submit a cover sheet (link here). Please provide TAG with a copy of the ERISA plan or other controlling arbitration agreement if possible. TAG will bill the responsible party for the administrative and evergreen retainer fees.

If a lawsuit was filed and the trial court compels the case to arbitration:

The respondent should forward the appropriate court documents to TAG. These include:

  • Plaintiff’s Original Petition
  • Defendant’s Original Answer
  • Order of Referral to Arbitration together with a Cover Sheet 
  • The controlling Arbitration Agreement



Fees

TAG will charge the responsible party a one-time, non-refundable administrative fee of $1,500.00 and a refundable evergreen retainer fee of $3,500.00. This is a fixed fee regardless of the number of parties involved or the amount in controversy. All of our arbitrators are billed at $450.00 per hour for study and hearing time, and at one-half rate, or $225.00 per hour, for travel time together with reasonable expenses.


Initiate a Mediation Case

Upon receipt of case pleadings, the case administrator will contact all parties regarding the details of the mediation. A mediator may be selected by the parties or by TAG. If the case is currently in arbitration with TAG, a mediator will be selected who is not the arbitrator in the case. Mediations are billed as follows: a one-half day mediation is $1,000.00 per party and a full-day mediation is $2,000.00 per party. Download the Mediation Cover Sheet:

Selecting an Arbitrator

When TAG receives the one-time, non-refundable administrative fee and refundable evergreen retainer fee from the responsible party, TAG will send the initial list of five potential Arbitrators to the parties to begin the selection process. Download the Arbitration Cover Sheet:
